Reporting of Offences

Citizens, employees and collaborators who intend to report illegal situations (acts of corruption and other crimes against the public administration, acts of alleged tax damage or other administrative offenses) of which they have become aware in the administration must use this model.

It should be remembered that the legal system protects those who report an offence.

In particular, the law and the National Anti-Corruption Plan (PNA) provide that:

  • the administration has the obligation to set up confidentiality protection systems regarding the identity of the whistleblower;
  • the identity of the whistleblower must be protected in any post-report context. In disciplinary proceedings, the identity of the whistleblower may not be revealed without his consent, unless his knowledge is absolutely essential for the defence of the accused;
  • the complaint is subtracted from the access provided for by articles 22 et seq. of Law no. 241 of 7 August 1990;
  • the complainant who believes that he has been discriminated against in the workplace because of the complaint, can report (also through the union) to the Public Service Inspectorate the facts of discrimination.
